    David Vogel, at the Haas School of Business at Cal Berkeley < http://www.haas.berkeley.edu/Faculty/vogel.html> has done a lot of work in this area and written several books.  See also the book by Susan Rose-Ackerman, Controlling Environmental Policy: The Limits of Public Law in Germany and the United States  (Yale U. P., 1995).
